NFT Artist Scores Big Win in Multimillion Dollar Contract Dispute Over a Blank Space

A recent lawsuit involving artist Danny Casale, also known as Coolman Coffeedan, and Florida LLC DigiArt has shed light on the importance of contracts and the need for clarity in legal agreements. The case, which was decided in favor of Casale, demonstrates how a seemingly minor detail, such as the absence of a start date in a contract, can significantly impact the outcome of a legal dispute.

The lawsuit was filed by DigiArt in March 2022, alleging breach of contract among other claims against Casale. DigiArt claimed that they had entered into an agreement with Casale in May 2021, granting them exclusive rights to market and sell Casale’s non-fungible tokens (NFTs) until May 2022. The agreement stipulated a 50-50 split of net sale proceeds from Casale’s NFTs.

According to the complaint, DigiArt invested significant resources in promoting Casale’s work, including organizing a pop-up exhibition and experience during Miami Art Week in December 2021. The pop-up shop, called “Ur Special Coffee,” featured Casale’s artwork on $1,000 paper cups, generating substantial press and attention.

Despite these efforts by DigiArt, Casale allegedly went on to market and sell 10,000 NFTs online under the collection name “Coolman’s Universe.” The trading volume of these NFTs reportedly exceeded $50 million on the online platform OpenSea.

However, in a surprising turn of events, Judge Wendy Berger dismissed DigiArt’s claims in a September 15 ruling, citing the lack of a start date on the initial signed contract. The judge’s ruling emphasized that the presence of blank spaces in a contract is fatal to its enforcement.

In response to the ruling, Casale’s attorney, Jordan Susman, stated that DigiArt had no agreement with his client and had no involvement with Casale’s successful NFT collection. Casale has spent the past year fighting the lawsuit, and the court’s ruling vindicates him as both a businessman and an artist.

The case serves as a reminder of the importance of clear and comprehensive contracts in any business or creative endeavor.
